6 common myths about workers’ compensation

On Behalf of | Sep 10, 2025 | Workers' Compensation

Ohio’s workers’ compensation system helps employees who suffer injuries on the job. However, misconceptions about the system can cause confusion. It’s important to clarify some of the most common myths surrounding workers’ compensation.

Myth 1: You can’t get workers’ comp if the injury was your fault

Ohio operates under a no-fault workers’ compensation system. This means that even if you caused the injury through negligence, you can still receive benefits. The key factor is whether the injury occurred during the course of your employment. If it did, you may qualify for compensation, regardless of fault.

Myth 2: Only full-time employees are eligible

Part-time, seasonal, and even some volunteer workers can receive benefits under the state’s workers’ compensation laws, provided they are classified as employees. The number of hours worked doesn’t determine eligibility; being an employee does. If you work for an employer and suffer an injury on the job, you can file a claim for compensation.

Myth 3: You must report the injury immediately

While it’s advisable to report an injury as soon as possible, missing the immediate reporting window doesn’t automatically disqualify you from benefits. State law allows you to file a claim even if you report the injury later, particularly if the injury wasn’t immediately apparent. The sooner you report the injury, the better, but late claims can still be eligible.

Myth 4: Your employer decides if your claim is accepted

Once you report your injury, your employer’s role is to notify their insurance carrier. The insurance company, not your employer, decides whether to accept or deny your claim. If your employer refuses to report your injury, you can file a claim directly with the Ohio Bureau of Workers’ Compensation (BWC).

Myth 5: Workers’ comp only covers medical expenses

The workers’ compensation system offers more than just coverage for medical bills. In addition to medical expenses, the system can provide compensation for lost wages, rehabilitation costs, and, in some cases, permanent disability benefits. The system aims to help you recover and return to work.

Myth 6: Filing a workers’ comp claim will get you fired

It’s illegal for your employer to retaliate against you for filing a workers’ compensation claim. If you face retaliation, you may have grounds to file a separate legal claim against your employer for violating your rights.

Understanding the facts about the workers’ compensation system can help you file a claim confidently and receive the benefits you deserve.
