Can you collect workers’ compensation and SSDI?

Workers who suffer from injuries that are related to their job duties may not be able to return to work right away. This can put them in a financial bind. In some cases, they may wonder if they can file for workers’ compensation coverage and Social Security Disability Insurance (SSDI) at the same time. 

It’s possible to file for benefits from both programs at the same time, but federal rules cap how much can be received in total. In Ohio, these programs are handled in a very specific manner. Understanding how these work together is critical. 

What is the limit for these programs?

Federal law limits the total of both programs together at 80% of what a worker’s average earnings were prior to them becoming disabled. If the total is more than 80%, one of the payments will have to be reduced so that the total is back within the allowable limits. 

In Ohio, the program that gets the reduction is workers’ compensation, which is known as a “reverse offset.” This is the complete opposite of the majority of states that opt to reduce SSDI. The reverse offset applies until the person receiving the benefits reaches full retirement age. At that point, a different set of rules applies to the distribution.
